On the 22nd of April one AAW agent travelled to Poland to help another ally in the fight against Genetically modified foods. Over the course of one week they travelled together across the country to three cities (Zwiec, Krakow and Nowy Sacz) as part of a graffiti mural tour organized by political graffiti artist 3fala named Genetically Molested Organisms...
1 - Mr X, passes a window owned by Mr Y and through that window, Mr X sees what he believes to be a crime being committed, i.e. a theft or assault by Mr Z.
2 - Mr X intervenes, smashing the window owned by Mr Y, in order to stop Mr Z from committing that crime.
3 - Mr X’s intent is not to damage or deprive the use of the property owned by Mr Y, his intent is obviously to prevent Mr Z from the committing the crime.
4 - That crime may or may not have anything to do with Mr Y, and it may even turn out that Mr Z was not actually committing a crime at all, but this does not change Mr X’s intentions.
5 - Mr X’s intentions arose out of the honest belief that he was preventing a crime. This gives him what is termed as 'lawful excuse', of which the full description is outlined in Section 5 of the Criminal Damage act. However there are still limits, the sections specifies that, ‘A person [Mr X] may use such force as is reasonable in the prevention of crime’. This means that demolishing a shopping center to prevent a shoplifter would most likely be considered excessive. Further this cannot be preemptive, the crime that is being prevented must be ‘immediate’, so Mr X could not smash the window ‘just incase’ Mr Z turns up...
